Payment

All prices in the Carrie Hill Creative Online Shop are displayed and checked out in US dollars (USD). The Carrie Hill Creative ONLINE SHOP accepts payment through Stripe. Payments are processed through Stripe’s API System.

If you are special ordering art in conjunction with an exhibition (e.g., Moving Past Pretty [forthcoming, Nov. 4, 2022], your invoice will be calculated in the national currency in which the exhibition took place.

Shipping

Shipping of standard-sized** physical items is subject to the following shipping fees:

Canada – FREE/Included

United States - $15.00 or FREE on all orders over $50

International - $20.00 or FREE on all orders over $80

**Note: Standard-size refers to envelope-sized orders
no larger than 10x13” (33x25cm) that easily fit
in letterboxes and weigh equal to or less than 0.01lb (30-50g)

All physical orders ship no later than 7-10 business days after receipt unless otherwise described on the product listing.  You will be sent an email notification when your purchase is en route. Physical products are packaged and sent via regular mail through Canada Post. Packages do not have tracking unless requested through email prior to ordering (subject to additional shipping charges). Separate shipping arrangements through FedEx, Purolator, or UPS can be requested, and will be invoiced in full to the client and must be paid prior to shipment. All physical orders are sent to the Shipping Address stipulated on the order form.

It is the responsibility of the Client to ensure that your shipping address is correct on your order. Carrie Hill Creative is not responsible for incorrect addresses listed on client orders. If an order is returned by the mailing service due to an incorrect address or a failure to collect your order from the specified postal facility in which the order is being held, the Client will be responsible for any return charge(s) incurred. Should the Client request a re-send of their order to an alternate shipping address listed on physical orders, any shipping charges, including tracking, will be invoiced to the client. Carrie Hill Creative reserves the right to charge a penalty should an order need to be resent to the Client.

Invoice payment is required before any orders are re-sent. Shipping charges can and do fluctuate, and as such the Client must reasonably expect adjustments to any shipping charges, even if they significantly deviate from the original shipping invoice.

Please note —

that in the case of Very Large Orders (e.g., an order with significant weight, non-standard and/or large packaging size, or that ultimately falls within the scope of special shipping at at the postal facility), a shipping quote may be invoiced separately via email to the Client, payable upon receipt. If this is the situation, the Client will receive written notice immediately. Explicit written consent to the adjustment of shipping and payment of the subsequent shipping invoice will be required by the Client before any Very Large Orders are shipped to the shipping address specified on the order form.

Carrie Hill Creative provides a 100% guarantee that every physical order sent to clients is brought to the mailing facility in impeccable and well-packaged condition in accordance with the type of order being sent to clients. Once a package has been delivered to the postal facility, Carrie Hill Creative is no longer responsible for the condition of any physical orders. Upon written request, deliveries can potentially be made in-person to the client if the driving distance is within a reasonable distance, and weather and/or road conditions permit. Additional fees may apply, which will be conveyed in writing to the Client before delivery takes place.

Cancellations and Returns

Sorry, there are no cancellations or refunds.  However, if you are unhappy with your purchase for any reason, please contact me and we will find a solution!

Exception: Under the EU’s distance selling laws, buyers from the European Union have the right to return unused, unopened product by contacting the seller within 14 days. This 14-day period will start the moment a customer receives a product. Any such requests must be made by contacting me via email at hello@carriehill.com.

Contract Signatures

Carrie Hill Creative accepts signed contracts in the form of handwritten, digital/e-signature, or typed-out signatures. You recognize, understand, and agree that you are legally bound by the terms of any and all contractual agreements made within the document once the document is signed and sent to Carrie Hill Creative. You understand that it is your responsibility to raise any concerns or questions about your contract to Carrie Hill Creative prior to signing any contracts, and that Carrie Hill Creative is not legally bound to honour any requests made after the contract has been signed.

Information Collection

To fulfill your order, you must provide certain information (which you authorize my shopping cart hosted at SquareSpace or Stripe to provide to me), such as your name, email address, postal address, payment information (I do not personally see your payment information, credit card details, etc.- as these are processed securely through SquareSpace or Stripe), and the details of your order. You may also choose to provide me with additional personal information if you contact me directly via email or by Website contact form, Order questionnaires, or through a private note attached to your order.

Why I Need This Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

- as needed to provide my services, such as fulfilling your order, settling disputes, or providing customer support;
- when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
- if necessary to comply with a legal obligation or court order or in connection with a legal claim, (such as retaining information about your purchases if required by tax law); 
- as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) compliance with SquareSpace and/or Stripe Policies and Terms of Use. I use your information as necessary to comply with my obligations under both the SquareSpace and Stripe Policy and Terms of Use.

Information & Sharing Disclosure

Information collection on my customers is necessary for the function of my business, however, rest assured I will not share your personal information except for very limited reasons and in specific circumstances, as follows:

SquareSpace. I share information with SquareSpace as necessary to provide services and comply with obligations under both the SquareSpace Seller Policy and SquareSpace Terms of Use.

Shipping Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies (e.g., Canada Post, Purolator, UPS, FedEx, etc.). I will share your personal information with these third parties, but only to the extent necessary to complete my services and ship your order.

Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data privately secured within my SquareSpace or Stripe account (sold order receipts) for a period of 5 years. I am required to download your personal data in order to purchase and print shipping labels either directly through Squarespace’s shipping service or from canadapost.ca; however, I promptly delete these files (within 7 days) after shipping your order. 

Transfers of Personal Data Outside the EU

I may store and process your information through third-party hosting services in Canada, North America and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

Change, restrict, delete: You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (i.e., I am required to store data for legal reasons) I will generally delete your personal information upon request.

Object. You can object to the processing of some of your information based on my legitimate interests, and to receiving marketing messages from me after providing your express consent to receive them, by contacting me. In doing so, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information, or if it is needed for legal reasons. To object and opt out of emails that you have previously given me personal consent to join, you may also click the "unsubscribe" button at the bottom of any emails sent to you from Carrie Hill Creative. This does not include messages direct from Squarespace or Mailchimp, as I do not send these emails personally and you would need to unsubscribe from Squarespace's or MailChimp’s specific emails and services in order to retract your consent there. 

Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
